CHARTER TERMS & CONDITIONS

These Charter Terms & Conditions (“Terms”) are intended to ensure a safe, enjoyable, and well-organized charter experience for all guests on board, while clearly defining the responsibilities of all parties involved.
They govern the booking and provision of crewed charter experiences operated and/or coordinated by Captain Juan (“Captain Juan”, “we”, “us”, “our”). By requesting, confirming, or participating in a charter experience, and/or by making any payment, the client (“Client”, “you”) acknowledges having read, understood, and accepted these Terms.
1. Definitions
Charter Experience: The overall experience coordinated by Captain Juan, including crew services, provisioning coordination, itinerary assistance, and guest experience management.
Vessel: The yacht or catamaran used for the Charter Experience.
Vessel Owner / Operator / Vessel Provider: Any third party owning and/or operating the Vessel, including charter operators, fleet companies, or private owners.
Booking Confirmation / Reservation Contract: The written confirmation issued for each booking describing the Vessel, dates, services, pricing, payment schedule, cancellation terms, and specific conditions applicable to that charter.
2. Role of Captain Juan
Captain Juan specializes in designing, coordinating, and delivering crewed charter experiences, including the management of crew, onboard services, provisioning logistics, and overall guest experience.
Charter Experiences may be operated using vessels:
- owned and/or operated by third-party providers; and/or
- managed by Captain Juan on behalf of private owners.
Unless expressly stated otherwise in writing, Captain Juan:
- is not the legal owner of the Vessel,
- is not the maritime carrier, and
- does not assume responsibility for the Vessel’s structural condition, seaworthiness, technical operation, or maintenance.
Matters relating specifically to the Vessel remain under the responsibility of the Vessel Owner/Operator and applicable insurance policies.
3. Contractual Documents & Acceptance
These Terms, together with the Booking Confirmation / Reservation Contract, form the contractual framework governing the Charter Experience.
Acceptance occurs upon:
- payment of any amount;
- written confirmation; or
- participation in the charter.
4. Quotations & Availability
All quotations are indicative until confirmed in writing. Availability is only guaranteed once confirmed and paid.
5. Payments
Each charter is customized; therefore, payment structures vary.
- Payments must be made on time.
- Late payments may result in cancellation without notice.
- Services may be delayed or suspended until payment is received.
Captain Juan may apply earlier internal deadlines to ensure coordination with suppliers and Vessel Providers. Any such deadlines will be communicated in advance.
6. Cancellations & Modifications
All cancellations or modification requests must be submitted in writing to crew@captainjuan.com
6.1 General Policy
Cancellation terms depend on:
- charter start date;
- booking contract terms;
- non-recoverable costs already incurred;
- and the applicable conditions of third-party Vessel Providers.
Given that most vessels are operated by third-party providers, cancellation timelines may be more restrictive than standard market conditions.
6.2 Third-Party Provider Aligned Cancellation Terms
When the Vessel is operated by a third-party provider, the following cancellation policy applies:
- More than 70 days before departure:
30% of the charter price (excluding extras) remains due. Extras already paid will be refunded. - 69 days or less before departure:
100% of the charter price remains due (excluding extras). - 17 days or less before departure:
Extras are also non-refundable.
These timelines include an additional operational margin applied by Captain Juan to ensure alignment with third-party commitments, crew scheduling, provisioning, and logistics.
6.3 Modifications
Requests to change dates, Vessel, destination, duration, or services:
- are subject to availability;
- may be treated as a cancellation and rebooking;
- are subject to updated pricing;
- previously applied discounts or special offers may not apply.
6.4 Third-party costs
Once committed, payments made to third parties are non-refundable, subject to their own policies.
6.5 Travel insurance
We strongly recommend purchasing comprehensive travel insurance covering cancellation, interruption, and medical expenses.
7. Force Majeure
Neither party shall be liable for non-performance caused by events beyond reasonable control, including but not limited to weather conditions, port closures, authority restrictions, natural disasters, epidemics or pandemics, or security concerns.
- No refunds shall be due
- Amounts paid may be credited for future use (subject to availability)
- Captain Juan is not responsible for additional costs
8. Weather, Safety & Authority Decisions
Charter itineraries are subject to weather, safety, and authority decisions.
The captain’s decisions are final.
No refund or compensation applies.
9. Itinerary Planning
All itineraries are indicative only.
They depend on:
- weather conditions
- sea state
- safety considerations
- authority instructions
The captain has full authority to modify the itinerary at any time.
Changes do not constitute breach of contract and do not give rise to refunds.
10. National Parks & Permits
Permits may:
- require additional payment
- be paid locally
- be non-refundable
11. Pets
Pets are strictly prohibited onboard and in protected areas.
12. Client Responsibilities & Conduct
Respect toward crew is mandatory.
Any abusive or inappropriate behavior may result in immediate termination without refund.
13. Crew Meals & Facilities
13.1 Bathroom access
Crew must have reasonable access to one bathroom.
13.2 Meals
If full board is not included, the Client must provide:
- adequate meals
- drinking water
Failure to do so may result in termination without refund.
14. Provisioning
If managed by the Client, adequate provisioning is their responsibility.
15. Fuel Policy
Fuel is not included unless stated.
The Vessel must be returned with full tanks.
16. Security Deposit
- Required at check-in
- Credit card only (no AMEX)
- Managed by Vessel Provider
17. Marina Parking
Client is responsible for compliance with marina rules.
18. Liability & Personal Belongings
The Client assumes inherent risks.
Captain Juan is not liable for:
- injury or illness
- loss of belongings
- third-party actions
19. Third-Party Terms
Third-party Vessel Provider terms apply to vessel-related matters and prevail in case of conflict.
20. Limitation of Liability
Liability is limited to amounts paid to Captain Juan (excluding third-party costs).
21. Communications & Claims
Claims must be submitted within 30 days after the charter.
22. Privacy
Personal data is used only for service purposes.
23. Governing Law
These Terms are governed by the laws of Mexico. Jurisdiction: Baja California Sur.
24. Severability
If any provision is invalid, the rest remain in effect.
25. Operational Information
Guides and pre-arrival information are non-binding.
26. Acceptance
Booking confirmation or payment implies acceptance of these Terms.
