CHARTER TERMS & CONDITIONS

These Charter Terms & Conditions (“Terms”) are intended to ensure a safe, enjoyable, and well-organized charter experience for all guests on board, while clearly defining the responsibilities of all parties involved.

They govern the booking and provision of crewed charter experiences operated and/or coordinated by Captain Juan (“Captain Juan”, “we”, “us”, “our”). By requesting, confirming, or participating in a charter experience, and/or by making any payment, the client (“Client”, “you”) acknowledges having read, understood, and accepted these Terms.


1. Definitions

Charter Experience: The overall experience coordinated by Captain Juan, including crew services, provisioning coordination, itinerary assistance, and guest experience management.

Vessel: The yacht or catamaran used for the Charter Experience.

Vessel Owner / Operator / Vessel Provider: Any third party owning and/or operating the Vessel, including but not limited to Dream Yacht Charter (DYC), other charter operators, fleet companies, or private owners.

Booking Confirmation / Reservation Contract: The written confirmation issued for each booking describing the Vessel, dates, services, pricing, payment schedule, cancellation terms, and specific conditions applicable to that charter.


2. Role of Captain Juan

Captain Juan specializes in designing, coordinating, and delivering crewed charter experiences, including the management of crew, onboard services, provisioning logistics, and overall guest experience.

Charter Experiences may be operated using vessels:

  • owned and/or operated by third-party providers, including but not limited to Dream Yacht Charter, other charter operators, or private vessel owners; and/or
  • managed by Captain Juan on behalf of private owners.

While Captain Juan oversees the Charter Experience as a whole, unless expressly stated otherwise in writing, Captain Juan:

  • is not the legal owner of the Vessel,
  • is not the maritime carrier, and
  • does not assume responsibility for the Vessel’s structural condition, seaworthiness, technical operation, or maintenance.

Matters relating specifically to the Vessel itself (including condition, equipment, fuel systems, damage deposits, and inventories) remain under the responsibility of the Vessel Owner/Operator and applicable insurance policies.


3. Contractual Documents & Acceptance

These Terms, together with the Booking Confirmation / Reservation Contract, form the contractual framework governing the Charter Experience.

Acceptance of these Terms occurs upon:

  • payment of any amount toward the booking;
  • written confirmation of the booking (email, message, or similar); or
  • participation in any part of the Charter Experience.

4. Quotations & Availability

All quotations are indicative until confirmed in writing. Availability of a specific Vessel, dates, crew, or optional services is only guaranteed once confirmed and the required payments have been received.


5. Payments

Each charter is customized, with costs that may include the Vessel, crew, chef, provisioning, logistics, and additional services. For this reason, payment structures vary from charter to charter, and fixed payment percentages do not apply.

Payment amounts and due dates are specified in the Booking Confirmation / Reservation Contract.

Unless stated otherwise:

  • payments must be made strictly by their due dates;
  • late or missing payments may result in cancellation without notice;
  • Captain Juan may delay or suspend service delivery until payments are received.

To ensure smooth operations and timely payments to Vessel Providers and suppliers, Captain Juan may apply earlier internal payment deadlines than those required by third parties. Any such deadlines will always be communicated in advance.


6. Cancellations & Modifications

All cancellations or modification requests must be submitted in writing to crew@captainjuan.com .

6.1 Cancellations

Cancellation fees and conditions depend on:

  • the charter start date;
  • the cancellation schedule specified in the Booking Confirmation / Reservation Contract; and
  • irrecoverable costs already incurred.

Given the advance planning required for crew scheduling, provisioning, and vessel coordination, cancellation timelines may be more restrictive than those applied by certain Vessel Providers.

6.2 Modifications

Requests to change dates, Vessel, destination, duration, or services are subject to availability and may be treated as a cancellation and rebooking under updated terms.

6.3 Third-party costs

Once committed, payments made to third parties (including Vessel Providers, crew, and suppliers) are non-refundable, subject to their own policies.

6.4 Travel insurance

We strongly recommend purchasing comprehensive travel insurance covering cancellation, interruption, and medical expenses.


7. Force Majeure

Neither party shall be liable for non-performance caused by events beyond reasonable control, including but not limited to weather conditions, port closures, authority restrictions, natural disasters, epidemics or pandemics, or security concerns.

In such cases:

  • no refunds shall be due;
  • amounts paid may be credited toward a future charter, subject to availability and third-party terms;
  • Captain Juan shall not be responsible for additional costs incurred by the Client.

8. Weather, Safety & Authority Decisions

Charter itineraries are subject to weather conditions, sea state, safety considerations, and decisions by maritime or port authorities.

For everyone’s safety, the captain’s decisions regarding navigation, timing, and itinerary adjustments are final.

No refund or compensation is due for changes resulting from such decisions.


9. Itinerary Planning & Weather Conditions

When planning the charter itinerary, Captain Juan and the crew will always seek to take the Client’s interests, preferences, and expectations into consideration in order to create the best possible experience.

However, the Client acknowledges that safety is always the top priority.

Any itinerary, route, or destination discussed prior to or during the Charter Experience is indicative only and provided for planning purposes.

The actual itinerary depends at all times on prevailing weather conditions, sea state, safety considerations, and instructions from maritime or port authorities.

For safety reasons, the itinerary is reviewed on a daily basis and may be modified at any time.

The captain has full authority to decide the route, timing, navigation, anchorages, and destinations necessary to ensure the safety of the Vessel, crew, and guests.

Changes to the itinerary do not constitute a breach of contract and do not give rise to any refund, compensation, or claim.


10. National Parks, Protected Areas & Permits

Certain cruising areas require mandatory permits or fees. Unless expressly included in the Booking Confirmation:

  • such permits and fees are additional;
  • they may need to be paid locally;
  • they are non-refundable once issued.

Compliance with all environmental and protected-area regulations is the Client’s responsibility.


11. Pets

For regulatory, safety, and environmental reasons, pets of any kind are strictly prohibited on board the Vessel and within National Marine Parks or protected marine areas, without exception.

Non-compliance may result in refusal of embarkation or termination of services without refund.


12. Client Responsibilities & Conduct

We are committed to creating a respectful and professional environment on board.

The Client agrees to treat the captain and crew with courtesy and respect at all times.

Any form of abusive, aggressive, or disrespectful behavior toward the crew is strictly prohibited, including but not limited to:

  • shouting or yelling;
  • insulting, demeaning, or offensive language;
  • verbal abuse, threats, or intimidation;
  • harassment of any kind.

If such behavior occurs, Captain Juan may suspend or terminate services immediately, without refund, in order to protect crew wellbeing and onboard safety.


13. Crew Meals & Facilities

13.1 Bathroom access

The crew must be granted reasonable access to one onboard bathroom at all times, in accordance with standard maritime practice.

13.2 Meals on charters without full board

When full board is not included, the Client is responsible for providing the crew with adequate meals and drinking water for the entire charter.

This includes a minimum of three (3) proper meals per day per crew member, comparable in quality and quantity to those provided to guests.

Charters often operate in remote areas with no resupply options. Failure to provide adequate food and water constitutes a material breach of these Terms and may result in:

  • operational adjustments;
  • suspension of services;
  • early termination of the Charter Experience;

without refund and without liability to Captain Juan.

Captain Juan will not continue services where crew health, wellbeing, or safety may be compromised.


14. Provisioning Awareness

If the Client chooses to manage their own provisioning, it is the Client’s responsibility to ensure sufficient supplies for the entire duration of the charter.

Captain Juan is not responsible for shortages or inconvenience resulting from insufficient provisioning.


15. Fuel Policy

The Vessel is delivered with full fuel tanks, including the main fuel tank(s) and the dinghy/tender fuel tank.

Unless expressly stated otherwise in the Booking Confirmation, fuel consumption during the charter is not included and remains the Client’s responsibility.

The Vessel and dinghy/tender must be returned with full fuel tanks at the end of the charter.

Refueling must be carried out at the marina fuel station or another authorized fueling facility, as instructed by the captain or Vessel Operator.

If returned without full fuel tanks, missing fuel and any applicable service or handling fees will be charged to the Client.


16. Security Deposit / Damage Deposit

At check-in, the Client must provide a security deposit as a guarantee against potential damage to the Vessel, its equipment, or accessories.

The amount of the security deposit depends on the Vessel and is specified in the Booking Confirmation / Reservation Contract.

The security deposit must be provided by valid credit card.

American Express cards are not accepted for security deposits.

The security deposit is managed exclusively in accordance with the Vessel Owner/Operator’s procedures and applicable local banking requirements. Captain Juan does not control the release or retention of the deposit.


17. Marina Parking & Vehicles

Parking within the marina is not included as part of the Charter Experience and is subject to the marina’s own rules and designated areas.

Areas may be available for temporary loading and unloading only. Vehicles must be relocated to authorized parking areas for the duration of the charter.

The Client is solely responsible for ensuring that vehicles are parked in authorized areas and in compliance with marina regulations.

Captain Juan is not responsible for fines, immobilization, towing, or other consequences resulting from improper or unauthorized parking.

Failure to request or follow parking instructions does not transfer responsibility to Captain Juan.


18. Liability & Personal Belongings

Maritime activities involve inherent risks. The Client assumes these risks for themselves and their guests.

To the extent permitted by law, Captain Juan is not liable for:

  • illness, injury, or accidents;
  • loss or damage to personal belongings;
  • acts or omissions of third-party providers;
  • events beyond reasonable control.

Adequate insurance coverage is the Client’s responsibility.


19. Third-Party Vessel Provider Terms

When a Vessel is owned or operated by a third party, that party’s terms apply to vessel-related matters.

For vessels managed by Captain Juan, the Vessel operates under the owner’s insurance, and Captain Juan acts solely as manager and coordinator.

In case of inconsistency, the Vessel Owner/Operator’s terms prevail with respect to vessel-related matters.


20. Limitation of Liability

To the fullest extent permitted by law, Captain Juan’s total liability is limited to the amount actually paid to Captain Juan (excluding third-party costs).

Indirect or consequential damages are not recoverable.


21. Communications & Claims

Any issue should be reported as soon as possible during the charter so it can be addressed promptly.

Post-charter claims must be submitted in writing within 30 days after charter completion.


22. Privacy

Personal data is used solely for booking and service purposes and handled with reasonable care.


23. Governing Law & Jurisdiction

These Terms are governed by the laws of Mexico. Any dispute shall be subject to the exclusive jurisdiction of the courts of Baja California Sur, Mexico.


24. Severability & Entire Agreement

If any provision is deemed invalid, the remaining provisions remain enforceable.

These Terms, together with the Booking Confirmation / Reservation Contract, constitute the entire agreement governing the Charter Experience.


25. Operational Information Provided Separately

Operational or pre-arrival information (including welcome or guest guides) is provided to assist preparation and does not replace these binding Terms.


26. Acceptance

By confirming a booking and/or making any payment, the Client accepts these Terms.
